Environmental Chain of Title Reports
Potential environmental liability is a major legal
concern in selling or purchasing real estate. Therefore,
an historical chain-of-title report is a crucial
component in any real estate transaction, as it
identifies previous owners and leases, and thus
potentially responsible parties.
One of the requirements to qualify for the innocent
landowner defense to CERCLA liability are practices that
constitute "all appropriate inquiry into the previous
ownership and uses of the property consistent with good
commercial or customary practice". "The defendant must
have undertaken, at the time of acquisition, all
appropriate inquiry into the previous ownership."
